These Terms and Conditions govern your access to and use of the EXISTĂM website, mobile application, digital platform, community features, content, services, donation tools, rewards mechanisms, shop features, events, partner services and any related digital or offline services made available by EXISTĂM.

By accessing or using EXISTĂM, you confirm that you have read, understood and agreed to these Terms.

2. Acceptance of Terms

By using the platform, you agree to comply with these Terms, our Privacy Policy, Community Guidelines, Child Safety Policy, Donation Rules, Rewards Rules, Shop Rules, Token Disclosures and any other applicable rules published by EXISTĂM.

If you use EXISTĂM on behalf of an organization, club, company, association or legal entity, you confirm that you have authority to represent that entity.

7. User Content

By posting content on EXISTĂM, you confirm that:

you have the right to publish it
it does not violate the rights of others
it is not illegal, abusive, misleading, fraudulent or harmful
it does not contain unauthorized personal data
it does not exploit, endanger or harm minors
it respects applicable laws and platform rules

You grant EXISTĂM a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt, distribute and make your content available as necessary to operate, promote and improve the platform, subject to your privacy settings and applicable law.

8. Prohibited Conduct

You must not use EXISTĂM to:

post illegal, abusive, violent, hateful or exploitative content
harass, threaten, shame, manipulate or intimidate others
impersonate any person, club, organization or professional
promote fraud, scams, fake services or misleading claims
publish dangerous medical, nutrition, training or recovery advice without proper qualifications
exploit minors or collect data from minors unlawfully
upload child sexual abuse material or any child exploitation content
promote doping, illegal substances or unsafe practices
sell illegal, counterfeit or prohibited products
manipulate rewards, referrals, donations, visibility or platform systems
use bots, scraping, spam, malware or unauthorized automation
interfere with platform security or operation
violate intellectual property rights
use the platform for unlawful political, financial, commercial or harmful activities

EXISTĂM may take action against accounts or content that violate these rules.

9. Health, Sport, Nutrition and Educational Content

Content on EXISTĂM may relate to sport, physical activity, nutrition, wellness, nature, education or sports medicine.

Professionals, coaches, instructors and organizations are responsible for the accuracy, legality and safety of the information they publish.

10. Donations and Support Features

Donation features may be operated directly by EXISTĂM, by affiliated entities, by partners or through third-party payment providers.

All donations or support actions may be subject to:

coins do not represent ownership in EXISTĂM
coins do not create investment rights
coins may expire, be limited or be revoked in case of abuse

Users must not manipulate rewards, create fake accounts, abuse referral systems or engage in fraudulent activity.

12. eXist Token and Digital Utility Components

Any reference to eXist Token or similar digital utility components is informational unless supported by official project documentation and applicable legal disclosures.

eXist Token is intended as a utility component within the EXISTĂM ecosystem, if and when legally and technically available.

Nothing on the platform should be interpreted as:

financial advice
investment advice
a public securities offer
a guarantee of profit
a promise of value increase
a guarantee of liquidity

Users must communicate respectfully and lawfully.

EXISTĂM may review, restrict or report communications where necessary for safety, legal compliance, abuse prevention, fraud investigation, child protection or platform integrity, subject to applicable law.

EXISTĂM has zero tolerance for child exploitation, child sexual abuse material, grooming, trafficking, abuse, harassment or any conduct that endangers minors.

We may remove content, suspend accounts, preserve evidence and report suspected illegal activity to competent authorities, hotlines or trusted safety organizations where required or permitted by law.

Users must not contact minors in inappropriate, exploitative, manipulative or unsafe ways.

Adults, coaches, instructors, clubs and organizations using the platform must comply with all applicable child protection, safeguarding, professional conduct and background-check obligations.

EXISTĂM may remove, restrict, label, reduce visibility of or disable access to content or accounts that violate these Terms, applicable law or safety standards.

Actions may include:

18. Intellectual Property

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, intentional misconduct or personal injury caused by negligence where applicable.

22. Indemnity

Where permitted by law, you agree to defend, indemnify and hold harmless EXISTĂM, its legal entities, officers, employees, partners and affiliates from claims, damages, losses or expenses arising from your misuse of the platform, violation of these Terms, illegal activity or infringement of third-party rights.

23. Suspension and Termination

We may suspend, restrict or terminate your access if we believe that you:

created risk for users or minors
